Public review of pesticide application permit

The DeAngelo Brothers Corporation has applied for a permit to apply pesticides along the White Pass & Yukon Route railway (right of way) from Lake Bennett into Carcross.

The proposed pesticides are Vantage, Hasten and Arsenal, which are potentially toxic to aquatic life, but are effective herbicide/weed control.

Permit review decision

The Government of Yukon has decided not to issue a permit to DeAngelo Brothers, LLC to spray pesticides along the White Pass and Yukon Route railway right of way within the territory at this time.

Our internal technical review and public and First Nation consultation identified deficiencies in the proposed application, resulting in the decision not to issue a permit.

DeAngelo Brothers, LLC was provided an opportunity to revise their application to address the deficiencies pursuant to s.88(2) of the Environment Act by August 10, 2016. A revised application was not received during that timeframe and therefore the file has been closed.

The most significant deficiency with the application was the proposed buffer zone. The Government of Yukon is not confident that this buffer zone will adequately protect either the aquatic environment or terrestrial habitat outside of the right-of-way.

Due to the nature of the railway’s path, and intermittent proximity to water, only 40 per cent of the right-of-way could be treated based on the proposed buffer distance of 15 metres.

The proposed method for identifying and protecting the 15-metre buffer is unsatisfactory, as it would depend on the applicators’ line of sight, individual judgement and inadequate maps.

There were also significant public and First Nation concerns regarding potential contamination to drinking water and harvestable flora and fauna. Environment Yukon is not confident those concerns could be mitigated, based on the project, as proposed.

The Government of Yukon received more than 45 submissions during the public review process and would like to thank everyone who participated.
